What Is Trademark Registration with Customs?

Trademark customs recordation is the process by which a rights holder registers their trademark with Customs to ensure it is protected in advance. Under the Regulations on the Customs Protection of Intellectual Property Rights, rights holders can request Customs to detain goods suspected of infringing their trademark. Customs may also proactively detain infringing goods during import or export inspections based on the information provided by the rights holder.

Since it is often challenging for rights holders to detect infringements on their own, customs protection primarily relies on the proactive actions of Customs authorities.

In practice, if a similar trademark appears in customs records, authorities will investigate and detain the associated goods. If trademark infringement is suspected, Customs will notify us, and we will inform you and guide you on the necessary steps to prevent further violations.

Dubai Customs charges administrative fees for opening a file to monitor goods passing through customs channels. With the trademark recording system in place, Dubai Customs has also implemented the Ex Officio border enforcement mechanism.
